This is a securities claim brought on behalf of institutional investors in the B3 Market Arbitration Chamber (“MAC”) in Brazil against a corporate accused of making false and misleading statements as to the risks associated with a large dam which ultimately collapsed, causing widespread damage to local communities.
This represents one of the first shareholder actions brought in the MAC.

Therium funded a BIT arbitration arising out of the expropriation of a mining asset by a Central-American State.
The State’s conduct caused the claimant financial difficulties and funding allowed the claim to proceed, thereby holding the State to account and upholding the rule of law.
With Therium’s support the claimant was able to pursue the claim to a final hearing which resulted in an award in its favour.
